Privacy and Security
1.1 The Nature Conservation Trust of NSW collects personal information from both its employees and from members of the public.
1.2 The Privacy and Personal Information Act 1998 (PPIA) establishes certain principles governing the manner and circumstances in which personal information may be collected and used.
1.3 This Policy sets out the manner in which the Nature Conservation Trust must collect and use personal information in carrying out the functions of the Nature Conservation Trust so as to comply with the provisions of the PPIA.
"Personal Information" is defined as information or opinion about an individual whose identity is apparent or can reasonably be ascertained from the information or opinion.
2.2 General Principles
2.2.1 Personal information must only be collected for a purpose that is directly related to a function or activity of the Nature Conservation Trust
2.2.2 Personal information must:
(a) be kept secure;
(b) only be accessible to staff of the Nature Conservation Trust with a proper reason to use the information; and
(c) disposed of in a secure manner.
2.2.3 A person in relation to whom the Nature Conservation Trust holds personal information may:
(a) request access to that information; and
(b) enquire as to the purposes for which it is being held.
2.2.4 A person in relation to whom the Nature Conservation Trust holds personal information may request the alteration of that information if they consider it is:
(c) out of date; or
(d) irrelevant to the purpose for which it was collected.
2.2.5 Any request made pursuant to paragraphs 2.2.3 and 2.2.4 of this Policy must be satisfied within 21 days of receipt. If, for any reason, this is not possible, the matter must be referred to the Chief Executive Officer for appropriate action.
2.2.6 Personal information relating to a person's ethnic or racial origins, political opinions, religious or philosophical beliefs, trade union membership, health or sexual activities must not be collected unless such collection and disclosure is necessary to prevent or lessen a serious and imminent threat to the life or health of a person.
2.2.7 Personal information must not be collected from the individual to whom it relates unless:
(a) that person authorises the collection of the information from someone else; or
(b) the information is collected from the parent or guardian of a person under the age of 16 years.
2.2.8 Where personal information is collected the person providing the information must be advised of:
(a) the purposes for which the information is being collected;
(b) the intended recipients of the information;
(c) the consequences (if any) of not providing the information; and
(d) the person's right to access and correct the information.
2.2.9 Personal information that is collected must be:
(a) relevant to the purpose for which it is collected;
(b) up to date; and
(c) must not intrude to an unreasonable extent on the personal affairs of the individual concerned.
2.2.10 Before any personal information is used, the staff member of the Nature Conservation Trust intending to use it must take reasonable steps to ensure that it is accurate, up to date, complete and not misleading.
2.2.11 Personal information must not be used for a purpose other than that for which it was collected unless:
(a) the person to whom the information relates has consented to the use of the information for that other purpose; or
(b) the other purpose is directly related to the purpose for which the information was collected; or
(c) the information is to be used to prevent or lessen a serious and imminent threat to the life or health of a person.
2.2.12 Personal information must not be disclosed to another person or body unless:
(a) the disclosure is directly related to the purpose for which the information was collected and there is reason to believe that the person concerned would not object to the disclosure; or
(b) the person from whom the information was collected is reasonably likely to have been aware or to have been made aware that information of that kind is usually disclosed to that other person or body; or
(c) disclosure is necessary to prevent or lessen a serious and imminent threat to the life or health of a person.
2.3 Application of General Principles in Specific Circumstances
2.3.1 Telecommunication systems used by the Nature Conservation Trust, including telephones, do not record conversations on recording equipment such as tapes or discs.
2.3.2 Information recorded in the course of a conversation will be recorded for the purposes of completing financial transactions e.g.receiving donations, or obtaining information of proposed property acqusitions.
2.3.2 The Nature Conservation Trust may make a record of your visit to our website and log your visit for statistical and business purposes. Such information includes your server address, domain name, IP address, the date and time of your visit, pages accessed, documents downloaded, previous site visited and the type of browser used.
2.3.3 If you send us an email message we will record your email address. We will only use your email address for the purpose for which it was provided. We will not use your email address for any other purpose (including adding it to any mailing list) without your express approval.
2.3.4 If we require you to complete an electronic form on this site and in doing so it requires you to enter personal information, we will collect that information to allow us to respond to your request. We will not collect personal information that would be unlawful, unnecessary or unrelated to Goalpost Pictures Australia activities or business.
2.3.5 Cookies are small files of information that save and retrieve information about your visit to our site. If you do not wish information to be gathered on a cookie it is possible to disable the acceptance of cookies by your web browser. If you want to do this you should contact your ISP. If this site uses a cookie to deliver contents we think will interest you, the cookie may also be used for authentication.
2.3.6 If this site contains a link to another site, we are not responsible for the privacy practices or the content of such other sites.
2.3.7 Personal information that is required to contact or communicate with staff of the Nature Conservation Trust (for example telephone and address lists) for administrative purposes may be collected and disclosed to members of the staff of the Nature Conservation Trust who require access to that information in order to carry out their functions provided that any staff member of the Nature Conservation Trust who is provided with the information complies with the general principles set out in paragraphs 2.2.2 and 2.2.12 of this Policy.
3. Use and disclosure
3.1. The Nature Conservation Trust does not sell, loan or give away information collected from any of our activities. No data collected from the web site will be disclosed to a third party except where the details are required to transfer information for volunteering and donations, where lease or rental finance arrangements are required, and where it is legally required, such as in the investigation of a criminal offence, and in compliance with a search warrant or subpoena.
4. Security Policy for online credit card donations
4.1 When making a donation to The Nature Conservation Trust of NSW your personal and financial details are passed through Westpac Bank’s PayWay online processing gateway and secure server. We use industry standard efforts to safeguard the confidentiality of your personal information, such as firewalls and Secure Socket Layers (SSL) 128-bit encryption.
